The Data Protection Act, 1998 gives you (the data subject) rights with regard to the processing of your personal data.  Your rights are explained below:

You have the right to see any of your personal data being processed by Torbay Council.  This can be done by making a 'subject access request'.  On receipt of a request a copy of your personal data will be provided to you.  You are also entitled to be informed why the Council is processing the information, the source of it and who it may be disclosed to.  However, there are some exemptions where this right of access does not apply.

If you believe your personal data is incorrect or inaccurate, please contact the Information Governance Team identifying the information you feel is incorrect and what should be done to correct it. If you are not satisfied with the outcome, you may contact the Information Commissioner or apply to the courts for correction or deletion of the information you believe to be incorrect.

You have the right to prevent your personal data being used for direct marketing purposes.  You will need to write to the data controller requesting them to cease processing your personal data for direct marketing purposes.

Where decisions affecting individuals are made based solely on the automatic processing of information, you have the right, upon providing written notice to the data controller to request the decision to be reconsidered or a new decision to be made on an alternative basis.

You have the right to seek compensation for any damage and distress suffered as the result of the data controller contravening the Data Protection Act 1998.
