LHA Rates
You can find out how much "rent" the council will use in the calculation of your Housing benefit by first of all working out the number of bedrooms your household needs according to the Regulations. Please click on the link below to take you to the council's LHA bedroom calculator.
Bedroom Rates
LHA rates are broken down into ‘Room Rates’ that will apply depending on the size of your household, including any other people who live with you. The size criteria is based on allowing one bedroom for:
- every adult couple
- any other adult aged 16 or over
- any two children of the same sex
- any two children regardless of sex under age 10
- any other child
The number of living rooms, kitchens and bathrooms is ignored for the purpose of the size criteria.

below. The LHA rates may change each month so you will need to look at the rate for the month in which you make your benefit claim, or the month in which it is treated as being made. As there is only one Broad Rental Market Area (BRMA) in Torbay these rates will apply wherever you live in Torbay.
Please note that from 6 April 2009 the maximum LHA rate will be restricted to five bedrooms for new claims and change of address claims.
Remember these rates are the maximum rent on which Housing benefit entitlement will be based and may be affected by income, capital or other people who live with you.
