Can anyone have a vehicle crossing?

There are certain roads within Torbay that are classified, these are main or well used roads. If your road is classified then you are required to get planning permission for a vehicle crossing.

What size does the vehicle crossing have to be?

There is no maximum size for a vehicle crossing. However the minimum area on private property for the use of storing a vehicle is 6m x 3.2m. Therefore the minimum size for a vehicle crossing is 2.5m. This is to avoid a vehicle overhanging the footway and causing a hazard to the footway users.

Do I have to have a vehicle crossing?

Yes. It is illegal to cross the footway without a certified vehicle crossing, the footway is not designed to take the weight of a vehicle constantly crossing it and can break up causing trip hazards. It is within the power of Torbay Council acting as the Local Highway Authority to stop this action any way it feels necessary.

Do I need planning permission?

This depends on the area going to be used for storing the vehicle. If you need to remove soil to a depth of 1m or more on your property you are required to obtain planning permission. If in any doubt it is always worth a phone call for peace of mind. You also need planning permission if your road is classified

Can I have any finish I like to my vehicle crossing?

No. The crossing must be constructed from concrete or bitmac as specified in the standard detail drawings . The crossing must also fall in line with whatever exists in the area already. Therefore if all the properties around yours has concrete crossing with a dropped and tapered kerb line then yours must also comply to these specifications.

Can the Council recommend a Contractor?

No. Torbay Council is not allowed to recommend contractors due to repercussions. All qualified contractors can be found in the Yellow Pages.

Somebody is a parking in front of my drive can the Council move them?

No. Cars causing an obstruction are a police matter. We would recommend in the first instance that you talk with any neighbours who's parking cause you problems before contacting the police. The police will only intervene if the crossing is completely blocked and there is no possible way to access your property. If a crossing is constructed but does not actually allow access to the property i.e. built up to a wall and the wall still remains. Then it is viewed as not providing access and the kerb is still a valid place to park.
